Terms and Conditions of Use for RVDiet

Application

Any account creation made with RVDiet constitutes an express and unconditional acceptance of the “Terms and Conditions of Use” which form an essential element of the contract and the mutual agreement between RVDiet and you (hereinafter “the Patient”).

The possible nullity of a clause in these general subscription terms shall not render the whole or part of these terms null; such a clause would be deemed unwritten.

Registration Conditions

In order to access RVDiet the Patient must provide an email address and choose a password.
By clicking the “validate” button, the Patient fully accepts these Terms and Conditions of Use as well as the Site Privacy Policy, which he acknowledges having read and understood.
The Patient also agrees to receive emails related to the use of his account, for example (non‑exhaustively): account creation confirmation, appointment reminders, …

Data Security

The application is designed to ensure a high level of data security, often far beyond industry practices. Below are some measures implemented, though not necessarily exhaustive:
- complete encryption of communications between the Patient’s device and our servers (HTTPS).
- passwords are never stored in plain text in our databases.
- the Patient’s personal data and identifying information (e.g., name, surname, postal address…) are stored encrypted in our databases.
- files “potentially uploaded by the Patient and stored in the application” are systematically encrypted and are decrypted only when accessed by the Patient or his/her duly identified caregiver.

Nevertheless, RVDiet does not hold any certification or authorization allowing it to store sensitive medical data. By accepting these Terms and Conditions, the Patient therefore commits not to store medical‑related data.

Use of Data

Regarding your account:
By creating an account on RVDiet you agree that the data concerning you (e.g., name, surname, email…) may be used for communication purposes, notably so that we can correspond with you about the evolution of RVDiet.

Regarding the data you store in RVDiet:
- They may be made accessible to the caregivers with whom you interact
- For the proper functioning of certain application features we may need to transmit some information to our technical partners. For example, sending appointment reminders via SMS involves transmitting a phone number, appointment date and time, and your name to our SMS service provider. We strive to limit the transmitted information to the strict minimum and do so securely. Moreover, our partners have no right to use this data without our consent.
- To optimise the application’s functionalities, we may carry out various computational and statistical processing of the data stored in RVDiet; these processes are always anonymised.

Liability

RVDiet assumes no liability, either towards its Patient or any third party, arising from the use of its application.
The content of RVDiet complies with French legislation. Therefore, if used outside French territory, it is the Patient’s responsibility to ensure beforehand that registration does not violate local laws.
RVDiet applies its expertise and technical skills to make the application as available as possible, yet it does not guarantee any specific uptime, execution speed, or other technical metric.

Force Majeure – Fortuitous Events

Considered fortuitous events or force majeure, relieving RVDiet of any obligation to act, are strikes, civil or foreign war, riots, acts of terrorism, total or partial destruction of premises and production facilities or others, manufacturing incidents, transport disruptions, supply difficulties, customs measures of any kind, Internet outages, telecommunication interruptions, or any other unforeseen event that wholly or partially prevents or delays the fulfilment of RVDiet’s obligations.

Intellectual Property

All data of the RVDiet application are protected by international intellectual‑property laws and conventions.
Any unauthorised reproduction, modification or use may result in criminal and civil proceedings.

Trademarks / Mentions

Any mention or use of trademarks, names, acronyms, logos, colours, graphics or other elements licensed to or owned by RVDiet is strictly prohibited unless prior written approval from RVDiet is obtained.

Jurisdiction Clause / Attribution of Jurisdiction

These general subscription conditions and the contracts to which they apply are governed by French law.
French courts shall have exclusive jurisdiction over any disputes arising from these general subscription conditions and the contracts to which they apply.

Modifications to the Terms and Conditions of Use

We reserve the right to modify this document at any time. The most current version is available at https://rvdiet.com/cgu_patient, which governs our use of your information at any given moment. If we amend these terms in a way we deem, at our sole discretion, to be substantial, we will notify you by email. By continuing to access or use the application after such changes take effect, you agree to be bound by the provisions set out in the new Subscription Terms.
